Terms of Use

By downloading, installing, or using the Protocol application ("App") on any platform, including Apple iOS and Google Android, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not download or use the App.

These Terms constitute a legally binding agreement between you and TrendPulse Indicators ("Company," "we," "us," or "our"). These Terms apply to your use of the App on any device or platform.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control for your personal, non-commercial use.

This license does not include the right to: (a) sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App; (b) modify, translate, adapt, or create derivative works based on the App; (c) reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code of the App; (d) remove or alter any proprietary notices, labels, or marks on the App.

Apple App Store. If you downloaded the App from the Apple App Store, your use is also subject to Apple's App Store Terms of Service. Apple is not a party to these Terms and has no obligation to provide any maintenance or support for the App. In the event of any conflict between Apple's terms and these Terms, Apple's terms will govern solely with respect to your use of the App Store.

Google Play Store. If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and has no responsibility for the App or its content.

In both cases, the App is licensed, not sold, to you. The platform provider (Apple or Google) is a third-party beneficiary of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

The App offers a free tier and optional paid subscription ("Pro") features. Subscription details, pricing, and trial terms are displayed within the App and in the applicable app store listing.

Billing. Subscriptions are billed through the platform you used to purchase (Apple App Store or Google Play). Payment is charged to your platform account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

Cancellation. You may cancel your subscription at any time through your Apple ID or Google account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial subscription periods, except as required by applicable law or platform policy.

Price Changes. We reserve the right to modify subscription pricing with reasonable notice. Continued use after a price change constitutes acceptance.

Trials. If you receive a free trial, you may be charged upon trial expiration unless you cancel before the trial ends.

THE APP IS DESIGNED FOR INFORMATIONAL, TRACKING, AND RESEARCH REFERENCE PURPOSES ONLY. THE APP DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

All content within the App — including compound profiles, dosage calculators, reconstitution calculations, pharmacokinetic models, and any other information — is provided for educational and research reference purposes only. It does not constitute medical advice and should not be treated as such.

You should always consult a qualified healthcare provider before beginning, modifying, or stopping any health protocol, medication, or supplement regimen. Never disregard professional medical advice or delay seeking it because of something you read or calculated within the App.

The compounds referenced in this App may not be approved by the FDA or other regulatory bodies for human use. Use of such compounds may be illegal in certain jurisdictions. It is your sole responsibility to understand and comply with applicable laws in your location.

You agree not to use the App to: (a) violate any applicable law or regulation; (b) transmit any content that is unlawful, harmful, or otherwise objectionable; (c) impersonate any person or entity; (d) interfere with or disrupt the App or servers connected to it; (e) attempt to gain unauthorized access to any portion of the App or its related systems.

Your use of the App is subject to our Privacy Policy, available at https://protocolapp.health/privacy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.

The App stores data primarily on your device. We do not sell your personal health data to third parties. Please review our Privacy Policy for complete details on data collection, storage, and use.

The App and its entire contents, features, and functionality — including but not limited to all information, software, text, displays, images, and design — are owned by TrendPulse Indicators and are protected by copyright, trademark, and other intellectual property laws.

These Terms do not grant you any right, title, or interest in the App, our trademarks, or any content we provide.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the App.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TRENDPULSE INDICATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitation may not apply to you.

You agree to indemnify, defend, and hold harmless TrendPulse Indicators and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights.

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice. Upon termination, your license to use the App will immediately cease. Sections 5, 8, 9, 10, 11, and 13 survive termination.

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in Denver, Colorado, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

App Store Disputes. Notwithstanding the above, any claims required to be resolved under Apple's or Google's applicable terms shall be resolved in accordance with those terms.

We may update these Terms from time to time. We will notify you of material changes by updating the effective date at the top of this page or by providing notice within the App. Your continued use of the App after changes become effective constitutes your acceptance of the updated Terms.
